There are processes that are symbolic because of what they condense: because they produce changes, because they are the result of them, or because they reflect them. The case against Dani Alves for sexual assault is already, without the trial having started (if there is no agreement, it will be this Monday), one of those processes. And it is also the first, media-driven, with the law of only yes means yes, a rule that was born precisely from a social change —regarding the perception of sexual violence—, and in turn, it propelled others. And they go beyond the criminal. “Because until now, we have only seen the negative aspects of the norm,” says jurist Altamira Gonzalo, referring to “the releases and reductions of sentences that have overshadowed the entire content of the law, that is, the comprehensive treatment given to women victims of sexual violence and that is what differentiates the context and consequences of a complaint after its entry into force from those made previously”.
